As a business owner, whether large or small, you have an obligation to yourself, your employees and society at large to do what is ethical, moral and legal. As an employee, you have as much right to hold your employer accountable for its ethical, moral and legal behavior as your employer holds you accountable for your work performance and work product.

*** IRS notations on the theft of Trust Fund Taxes….it is a Felony offense, especially if one tells the IRS that one is utilizing the money to put back into the business but in reality, one is using it to vacation in Europe or buy a new car, etc., then one is not only ‘stealing’ trust fund taxes, one is also lying to government agents; also addresses those issues of having IRS trust fund payment plans, non-adherence to the payment plans as well as non-payment of present trust fund taxes….and ‘deception’ as to the reason of non-payment;
***Wage Theft issues…a link to the Pennsylvania Department of Labor Wage Theft page for both employers (who want to insure that they are properly paying their employees) and employees (who want to report Wage Theft or have classification questions);
***Pennsylvania State Law for employers on what to do if an ‘employee’ does not pick up their last pay check…the paycheck belongs to the Commonwealth and it is illegal to put funds back into business account;
***Consequences for a business of falsifying information on a Request for Proposal for an entity that is considered a Federal Contractor; consequences for employees (especially Officer of organization) of knowing that false information was passed to entity, whether the individual signed RFP or not; consequences of applying false information to any RFP, especially one that has been awarded to falsifier;
***Consequences for a business/employees of offering employees money to collect Unemployment Compensation while working for ‘cash’ or ‘no money at all’ and employer giving/employee receiving a bonus for doing so at a later date;
***Consequences of collecting sales tax for the Commonwealth and falsifying monthly reports, hiding revenue, collecting large amounts of sales tax payments from clients and utilizing the moneys for other purposes for an extended period of time; Businesses should note that even if payment is made at a later date, a crime has been committed…stealing sales/use tax moneys is a Commonwealth offense;
***What to do when/if your paycheck bounces;
***Governance ...the obligations of being a member of a Board..NFP or Profit;
***Federal Tax guidelines for 2015 including FICA, Medicare, etc.;
***401(k) contribution rates for 2015;
